Himalayan Bullion Company Limited
Terms of Sale
1. Who we are
Himalayan Bullion Company Limited ("HBC", "we", "us") sells physical silver and physical gold products. You can reach us at info@himalayanbullion.com.
We are not a bank. We do not take deposits, we pay no interest, and nothing you buy from us is a guaranteed-return investment. When you buy from us, you are buying a specific physical product.
2. The HBC app and your account
These terms cover both the HBC customer app and anything you buy from us through it. You can browse, see rates and read these terms without an account. Some things — the arrangements in section 5, your credit, your documents — need you to be signed in.
The app is general-audience. It is not designed for children, and we do not direct it at them.
3. What we sell
Physical silver and physical gold products. We also show metal rates. A rate on its own is not a product you can buy — if there is no product available to purchase, the rate is information, not an offer.
4. Prices you see, and the price you pay
Prices shown in the app and in our store are indicative. They move with the metal market.
The rate that applies to your purchase is fixed when your first payment is confirmed. Not when you open a checkout, not when you see a figure on a screen, and not when you start a payment. Until that confirmation, any figure is an estimate of what you would pay if you paid at that moment.
5. Your first payment creates a binding agreement
When your first payment is confirmed, you and HBC have a final and binding agreement that you will buy that product at that rate.
This is true whether you pay in full or in part. It has three consequences, and we would rather you read them now than discover them later:
- - You cannot cancel it through the ordinary order-cancellation route. There isn't one for a confirmed purchase.
- - The order stays open until the balance is paid, and the unpaid balance remains owed.
- - Not paying does not cancel anything. We do not forfeit what you have paid, we do not resell your product, we do not take ownership of it, and the agreement does not expire. It stays open, and the balance stays due.
We call what you pay your initial payment, partial payment, or amount paid toward the order. We do not call it a deposit, because a deposit means something else.
6. When the product becomes yours
Paying in full and owning a specific product are two different things, and they happen at different times.
A product becomes yours when both of these are true:
1. your full payment has been confirmed; and
2. the specific metal or product has been allocated to you by us.
Fixing a rate does not make you the owner of a particular bar, coin or piece. Until allocation, you have a binding agreement for a product of the kind you bought — not title to a specific one.
7. Preparing your product, and your eight-week collection period
Paying in full does not mean your product is ready to collect that day. We may need part of that period to allocate, mint, prepare, verify or otherwise ready it.
Your eight-week collection period begins when your full payment is confirmed. Our preparation happens inside that same period. It does not postpone, pause, restart or extend the deadline.
Unless we decide not to fulfil your order under section 14, we will make the product ready for collection no later than the end of those eight weeks.
The period begins and ends by reference to your confirmed full payment. It does not depend on a ready-for-collection notice, on your acknowledgement of one, or on whether any message reaches you. We may send you a courtesy message when your product is ready, and we may send reminders. Those messages change none of these dates, and a reminder never restarts the period.
If we are late, you are not charged for our delay. If we have not made your product ready for collection by the end of the eight weeks, any overstay charge under section 8a begins only from the day after we do make it ready — never from the end of the eight weeks.
8. Collecting it, or leaving it with us
During the eight weeks that begin when your full payment is confirmed, you must do one of two things:
- - Collect it — once the product is available, pick a date and collect it from us; or
- - Keep with HBC — leave it with us under a separate Custodian Agreement, which you sign and which covers custody charges and insurance, once the requirements for custody can be met.
Custody starts only when you have chosen Keep with HBC, signed that agreement, and the custody charge has been paid. All three. Charging starts from that moment, and activating custody gives up whatever remains of your free eight-week collection period.
8a. If the eight weeks pass without collection or custody
The deadline is eight weeks from your confirmed full payment.
If, by the end of that period, you have neither collected the product nor placed it into active custody with us, an overstay charge of 0.008% per day applies, on the value basis your order established.
- - It must be settled separately, before collection or sale.
- - It is never deducted from sale proceeds, and never taken out of your credit.
- - You do not lose ownership. Delay does not forfeit your product, does not transfer it to us and gives us no right to sell it. Unpaid charges remain owed, and the product remains yours.
9. Identity checks
We check identity in person at our counter. We may also need to verify who you are — or ask you to sign in again — for other security-sensitive things, such as selling a product back to us, a cheque refund of your credit, deleting your account, recovering access, or verifying a business.
10. Credit on your account
Credit on your HBC account is for buying HBC products. It is not transferable, it is not a deposit, and it earns no interest.
The app does not pay out credit as cash. Credit can be refunded by cheque, and to arrange that you must come to HBC in person and show acceptable identification. We are the account holder's only counterparty for this — we cannot arrange it for somebody else on your behalf.
11. Documents and receipts
We issue a receipt for money we receive. Documents we have issued are permanent records: we do not alter them afterwards. A correction is a new document linked to the original.
12. Layaway
If you buy through layaway, the Layaway Terms apply in addition to these. They are published alongside these terms and you accept them separately.
13. Selling a product back to us
If we buy a product back from you, that is a separate transaction, confirmed at the time. It does not change or undo your original purchase. The Buyback Disclosure applies to it.
14. If we cannot fulfil your order
Rarely, we may decide not to fulfil an order. If that happens, we refund every amount you have paid toward that order. That refund carries no interest and no additional compensation.
This is not a right for you to cancel. It is what we do if we choose not to go ahead.
15. Changes to these terms
We may publish a new version. If a change is material we will ask you to accept the new version the next time it applies to something you are doing. A non-material change is shown to you as a notice.
Every version we have published stays available by version number, with the digest that identifies it, so you can always see the exact wording you agreed to.
These terms are published in English, and English is the authoritative and governing version. If we ever publish a translation, it is provided for convenience and the English version governs.
